Marijuana Legislation

At the Idaho Citizens Coalition, we evaluate all proposed legislation for cannabis in Idaho based on What We Believe. We will OPPOSE any legislation we believe is harmful to our cause, call to AMEND legislation that inadequately improves our position, and SUPPORT legislation that is beneficial to our cause.   • OPPOSE SJR 101 Constitutional Drug Prohibition Amendment—Passage would ban any citizen initiative to change drug laws in Idaho and tie Idaho’s drug laws to FDA approval (which can never approve whole plant cannabis). Read more about it.
  • AMEND HB 108 Kitzhaber Medical Marijuana Act—This “stricter than Utah” medical marijuana bill “treats marijuana like OxyContin.” Its superior qualifying condition list and patient protections make this bill worth amending to remove “cannabis pharmacy” language that dooms Idaho dispensaries and “medicinal dosage forms” language that won’t work for patients.   • AMEND HB 126 Industrial Hemp Legalization—Bringing Idaho’s hemp laws in line with the rest of North America seems a no-brainer, but problematic “license” language could imperil average citizens possessing full spectrum CBD oil or hemp flower. Read more about it.
  • SUPPORT SB 1017 Epidiolex is not Marijuana—This bill removes a pharmaceucal CBD product from the criminal definition of marijuana, as it and all marijuana should be. Read more about it.
  • OPPOSE HB 223 Ballot Collection Prohibition—This bill makes it a felony to collect absentee ballots to be mailed to election officials. While not a marijuana bill, we oppose all efforts to make it harder for the citizens of Idaho to exercise their constitutional power to determine Idaho’s laws by initiative. Read more about it.
  • OPPOSE HJR 2 Geographic Signature Requirements in Constitution—State law says that initiatives must collect 6% of voters’ signatures from 18 of 35 legislative districts, a geographic requirement we believe violates “one man, one vote,” as collecting 6% of signatures is easier in small urban districts than large rural districts. This resolution would amend these requirements to the constitution. Read more about it.
  • OPPOSE SB 1110 Signature Requirements from All Districts—If the requirement to gather 6% of signatures in 18 of 35 districts is bad, this change in law to make it all 35 of 35 districts is worse! Read more about it.
  • OPPOSE HJR 3 Citizens Arrest for Misdemeanors—This is a tricky bill. The purpose is to give law enforcement power to detain and search persons who’ve been accused of misdemeanors and held under citizens arrest. It’s to address domestic violence, but so long as marijuana possession is a misdemeanor, we’re wary of granting police more powers to search us based on the word of random civilians. Contact Your Legislators

The 70 representatives of the Idaho House and the 35 senators of the Idaho Senate work for the people of Idaho, regardless of how those people may have voted.

Please let them know that you oppose Idaho Sen. C. Scott Grow’s proposed medical marijuana prohibition amendment, SJR 101.

State Sen. C. Scott Grow has proposed an amendment to the state constitution that would not only ban all marijuana (even hemp!) forever in Idaho, it would make it impossible for the people of Idaho to ever pass an initiative to overturn the ban. WE NEED YOUR HELP! Legislators need to know that the people of Idaho — YOU! — are against this constitutional amendment.

Some points to make, use any of them you like, in your own words:

  • This would ban medical marijuana forever.
  • This would ban industrial hemp forever.
  • The people could never overturn that ban, because the people can’t propose amendments.
  • This ties Idaho’s Constitution to the federal FDA.
  • The FDA can never regulate marijuana—it can’t regulate plants.
  • If the people don’t want marijuana, they can just vote no on marijuana initiatives.
  • Polls show 3/4 of Idahoans want medical marijuana.
  • The federal government is set to pass the MORE Act, which would end federal prohibition. Idaho’s marijuana laws would then be stricter than the feds.
  • This amendment is a backdoor attempt to stop Idahoans from legalizing medical marijuana.
  • This amendment shows the legislature knows the people of Idaho want and would pass a medical marijuana law, like every state around Idaho already has.
